The National Institution for Human Rights in Libya (NIHRL) has denounced the establishment of a Supreme Constitutional Court in Benghazi, deeming the move "unconstitutional."
In a statement, the institution argued that the law establishing the court had already been ruled unconstitutional and that issuing such a law would require a constitutional amendment, along with changes to Law No. 6 of 1982, which governs the formation of the Supreme Court.
The NIHRL urged judiciary members across all levels to "maintain the unity of the judicial authority, defend its independence, and prevent any interference in its affairs."
In June 2023, the Constitutional Chamber of the Supreme Court in Tripoli declared Law No. 5 of 2023 -passed by the House of Representatives to establish a Supreme Constitutional Court- as unconstitutional.
