The Legal Department of the Supreme Judicial Council responded to the request of the disputed Head of the High Council of State, Khalid Al-Mishri, to express a legal opinion on the result of the election of the presidency of the High Council of State, which took place on August 6, stressing that it “does not have jurisdiction to decide on the issue.”
The Head of the Legal Department of the Supreme Judicial Council, Abdul Hakim Aribi, addressed Al-Mishri’s letter issued on August 13, in which he requested the Council to “express a legal opinion on the extent to which a ballot paper that was disputed during the election process for the presidency office of the High Council of State on August 6, 2024 is valid.”
Arabi said in his response to the request this was a matter that fell outside the specific framework of the tasks assigned to this department. He concluded at the end of his response that what Al-Mishri presented to the Legal Department of the Supreme Judicial Council “is applicable to the meaning referred to above, and the matter requires presenting it to the competent judiciary to decide on it in accordance with the provisions of the applicable laws and internal regulations of the High Council of State."
The dispute over the presidency of the High Council of State continues between the former Head of Mohamed Takala, and Al-Mishri, who began performing the duties of the Head after he announced his victory in the elections, which Takala wanted to be repeated or referred to the judiciary to resolve the dispute over the ballot paper that sparked controversy among the members of the council.
